These Terms & Conditions apply to all equipment rentals made through Kimbu Rental, whether booked online, by phone, by email, or in person. By submitting a rental request, signing a rental agreement, accepting delivery, or taking possession of any equipment, the renter agrees to be bound by these Terms & Conditions.
1. Equipment Ownership
- All equipment rented through Kimbu Rental remains the sole property of Kimbu Rental at all times.
- The renter is granted a temporary right to use the equipment only for the agreed rental period.
- The renter may not sell, transfer, assign, pledge, sub-rent, or otherwise allow unauthorized third parties to use the equipment without prior written approval from Kimbu Rental.
2. Identification & Verification
- Kimbu Rental may require valid identification and contact information before releasing equipment.
- Individual renters may be asked to provide a government-issued identification document and proof of contact details.
- Business or corporate renters may be required to provide company registration details and an authorized representative.
- Kimbu Rental reserves the right to request a refundable security deposit based on the value of the equipment, rental duration, rental history, or other relevant factors.
3. Account Approval & Eligibility
- Submission of a membership application or rental request does not guarantee approval.
- Kimbu Rental reserves the right to verify any information provided by applicants before approving rentals.
- Kimbu Rental may refuse, suspend, or terminate rental privileges where information cannot be verified, where previous rental obligations remain outstanding, or where a rental request presents an unreasonable business risk.
4. Rental Period
- The rental period begins when the equipment is collected, delivered, or otherwise made available to the renter.
- The rental period ends when all equipment has been returned and checked in by Kimbu Rental.
- Requests to extend a rental period must be made before the scheduled return time and are subject to equipment availability.
- If an extension request is not approved, the equipment must be returned on or before the agreed return time.
5. Equipment Condition & Use
- Renters are encouraged to inspect equipment at the time of collection or delivery and immediately report any concerns.
- Equipment must be used only for its intended purpose and in accordance with the manufacturer’s operating guidelines.
- The renter must take reasonable care to protect equipment from avoidable damage, misuse, theft, weather exposure, excessive moisture, dust, sand, impact, or other harmful conditions.
- The renter must not attempt repairs, modifications, disassembly, or alterations without prior authorization from Kimbu Rental.
- Equipment must be returned in substantially the same condition in which it was supplied, excluding reasonable wear resulting from normal use.
6. Damage, Loss & Theft
- The renter is responsible for the equipment while it is in their possession or control.
- If equipment is damaged, lost, stolen, or returned in a substantially different condition than supplied, the renter may be responsible for reasonable repair, replacement, cleaning, or restoration costs.
- The renter is responsible for ensuring that all supplied accessories, batteries, chargers, cables, cases, memory media, adapters, and other included items are returned at the end of the rental period.
- Normal cosmetic wear resulting from ordinary and proper use will not generally be considered chargeable damage.
- Kimbu Rental will provide reasonable supporting information regarding repair or replacement charges where applicable.
7. Late Returns
- Equipment returned after the agreed return time may be subject to additional rental charges.
- Additional charges may continue to apply until the equipment has been returned and checked in by Kimbu Rental.
- If a late return directly impacts another confirmed booking, Kimbu Rental may recover reasonable costs arising from the delay.
8. Equipment Availability
- All bookings are subject to equipment availability.
- Kimbu Rental reserves the right to substitute equivalent equipment where reasonably necessary.
- In the event equipment becomes unavailable due to circumstances beyond Kimbu Rental’s reasonable control, Kimbu Rental’s liability shall be limited to refunding any rental fees paid for the affected equipment.
9. Cancellations
- Cancellations made more than seventy-two (72) hours before the rental start date may be eligible for a full refund or rental credit.
- Cancellations made between twenty-four (24) and seventy-two (72) hours before the rental start date may be subject to a cancellation charge.
- Cancellations made less than twenty-four (24) hours before the rental start date, or failure to collect reserved equipment, may result in partial or full forfeiture of any booking payment made.
10. Drones & Restricted Use
- Renters of drone equipment are solely responsible for obtaining any permits, permissions, approvals, or authorizations required by applicable laws and regulations.
- Renters must comply with all applicable regulations issued by relevant authorities in Nepal.
- Equipment must not be used for any unlawful activity.
- Kimbu Rental reserves the right to refuse rentals where the intended use presents an unreasonable safety, legal, or operational risk.
11. Limitation of Liability
- Kimbu Rental takes reasonable steps to maintain and prepare equipment for rental use.
- To the maximum extent permitted by law, Kimbu Rental shall not be liable for indirect, incidental, special, or consequential losses, including production delays, lost revenue, lost business opportunities, travel expenses, accommodation costs, lost footage, or similar losses.
- Renters are encouraged to maintain appropriate insurance coverage and backup procedures where necessary.
12. Governing Law
- These Terms & Conditions shall be governed by and interpreted in accordance with the laws of Nepal.
- Any dispute arising from or relating to these Terms & Conditions shall be subject to the jurisdiction of the competent courts of Kathmandu, Nepal.
- Electronic acceptance of these Terms & Conditions shall have the same effect as a written signature to the extent permitted by applicable law.
